1. Who We Are

Don't Tell Dad [Don't Tell Dad Trading FZCO] ("we", "us", "our", "Don't Tell Dad") operates the website www.dtdthelabel.com (the "Site"), through which we sell women's fashion and accessories ("Products") to customers in the United Arab Emirates and, where stated, the wider GCC region and internationally.

2. Language

These Terms are provided in English for your convenience. An Arabic-language version is available on request at hello@dtdthelabel.com. Where required by applicable UAE law, the Arabic version shall prevail in the event of any conflict or ambiguity between the two versions.

3. Acceptance of These Terms

By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms of Service ("Terms") and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, please do not use the Site.

We may update these Terms from time to time (see Section 22). The version in force at the time you place an order applies to that order.

4. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to place an order on the Site. If you are under 18, you may browse the Site only with the involvement of a parent or guardian.

5. Your Account

You may need to create an account to place an order. You are responsible for keeping your login details confidential and for all activity under your account. Notify us immediately at hello@dtdthelabel.com if you suspect unauthorised use of your account.

We may suspend or close an account that we reasonably believe is being used fraudulently or in breach of these Terms.

6. Products and Descriptions

We try to describe and display Products, including colours, fabric, and sizing, as accurately as possible. Colours may vary slightly depending on your device's display, and minor variations in fabric, print placement, or finish may occur, particularly for small-batch items.

Please refer to our size guide before ordering; we are not able to guarantee fit.

We reserve the right to limit order quantities, discontinue a product, or correct pricing or description errors at any time, including after an order has been placed, in which case Section 9 (Order Acceptance) applies.

7. Prices, Currency, and Payment

Prices are displayed in UAE Dirhams (AED) unless another currency is shown at checkout for international customers, and are inclusive of UAE Value Added Tax (VAT) at the applicable rate (currently 5%) unless stated otherwise.

We accept payment via Visa, Mastercard, Apple Pay, through our payment gateway, Shopify payments. We take reasonable care to ensure prices are correct, but errors may occur. If we discover a pricing error on an order you have already placed, we will contact you before dispatch so you can confirm whether to proceed at the correct price or cancel for a full refund.

8. Promotions, Discount Codes and Gift Cards

Discount codes and promotions are valid only for the period and on the terms stated at the time of the offer, are not combinable unless expressly stated, cannot be applied retroactively to earlier orders, and have no cash value.

Gift cards are valid for 12 months from the date of purchase, are non-refundable, and cannot be redeemed for cash except where required by law.

9. Order Acceptance and Contract Formation

Your order is an offer to purchase. Our order confirmation email acknowledges receipt of your order but does not mean we have accepted it. A contract between us is formed only when we send you a dispatch confirmation email confirming that your Products have been shipped.

We may decline or cancel an order (in whole or in part) for reasons including stock unavailability, a pricing or description error, suspected fraud, or failure to meet the eligibility requirements in Section 4. If we cancel an order after payment has been taken, we will refund you in full within 30 business days.

10. Shipping and Delivery

We currently deliver within the United Arab Emirates and Worldwide. Estimated delivery times and shipping costs are shown at checkout, these are estimates only and not guaranteed delivery times.

Risk in the Products passes to you on delivery. For international shipments, you are responsible for any customs duties, import taxes, or other charges levied by the destination country; we have no control over these charges and cannot predict their amounts.

If delivery is delayed by an event outside our reasonable control (see Section 20, Force Majeure), we will let you know as soon as possible and take reasonable steps to minimise the delay.

11. Returns, Exchanges and Cancellations

Unlike some other jurisdictions, UAE law does not impose a general statutory "cooling-off" right allowing consumers to cancel an online purchase for any reason within a fixed number of days. Your ability to return or exchange an item is set out in this returns policy, alongside your rights under UAE Federal Decree-Law No. 15 of 2020 on Consumer Protection and its Executive Regulations, which entitle you to accurate product information, a safe and fit-for-purpose product, and a right to complain to the relevant authority (see Section 21).

We nonetheless offer a return window of 14 days from the date of delivery for a refund, provided the item (s) is unworn, unwashed, undamaged, and returned with it's original tags and packaging attached. We offer a 14 days refund policy for online payments only. Card refunds will be processed within 7 days of the refund being accepted but can take up to 14 days to be refunded back onto the original card used for purchase. Refunds are processed once the item (s) are received back to us.

The following items are final sale and cannot be returned or exchanged unless faulty:

• swimwear
• Hats
• Items marked "Final Sale" or purchased in a clearance/sample sale
• Gift cards
• Jewellery

12. Faulty, Damaged, or Incorrect Items

If a Product is defective, damaged in transit, or does not match its description, please contact us within 7 days of delivery at hello@dtdthelabel.com with your order number and photos of the issue. In accordance with the UAE and also UK Consumer Protection Law, we will offer a repair, replacement, or refund as appropriate, and will cover return shipping costs where the Product is faulty.

13. Intellectual Property

All content on the Site — including the Don't Tell Dad name and logo, product photography, graphics, text, and design — is owned by or licensed to us and is protected under applicable UAE and international copyright, trade mark, and intellectual property laws. You may not reproduce, distribute, or use our content for commercial purposes without our prior written consent.

14. User Content

If you submit reviews, photos, or other content to us (including by tagging us on social media), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in connection with promoting Don't Tell Dad, across our Site and social channels, unless you tell us otherwise. You confirm that any content you submit is your own and does not infringe anyone else's rights.

We may remove any content we consider unlawful, offensive, or in breach of these Terms.

15. Acceptable Use

You agree not to use the Site for any unlawful purpose, and in particular not to post or transmit content that is defamatory, offensive, false, or otherwise unlawful under UAE Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrimes. You also agree not to attempt to gain unauthorised access to our systems, introduce viruses or harmful code, or interfere with the proper working of the Site.

16. Limitation of Liability

To the maximum extent permitted by UAE law, our liability to you for losses arising from your use of the Site or purchase of Products is limited to the price you paid for the relevant Products, and we exclude liability for indirect or consequential losses. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under mandatory UAE law.

We are not liable for delays or failures caused by events outside our reasonable control (see Section 20).

17. Indemnity

You agree to indemnify us against reasonable losses or costs we incur as a result of your breach of these Terms or misuse of the Site, except where caused by our own breach or negligence.

18. Privacy and Data Protection

We process your personal data in accordance with the UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021) [and, if applicable, the data protection regulations of the free zone in which we are registered, e.g. the DIFC Data Protection Law], as set out in our Privacy Policy. By using the Site, you acknowledge that processing.

19. Cookies

The Site uses cookies as described in our Cookie Policy. You can manage your cookie preferences through your browser settings or our cookie banner.

20. Force Majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including strikes, courier delays, extreme weather, or supply chain disruption.

21. Complaints and Consumer Protection

If you have a complaint, please contact us first at hello@dtdthelabel.com so we can try to resolve it directly. You may also raise a consumer protection complaint with the Dubai Department of Economy and Tourism (Consumer Protection section) or the UAE Ministry of Economy, as applicable.

22. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in the law or in how we operate. Updated Terms will be posted on the Site with a new "Last updated" date. Changes will not affect orders placed before the change took effect.

23. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

24. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates [as applied in the Emirate of Dubai / and the rules and regulations of FZCO, as applicable to our registration]. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the [Dubai Courts / DIFC Courts – to be confirmed based on your entity's registration]
